HEARING OFFICER ORDER
Summary of Rules
On March 16, 2000, the Board proposed new procedural rules at 35 Ill. Adm. Code
101-130. The proposal governs how persons initiate and participate in all proceedings before
the Board. As the Board explained in the opinion proposing these rules, the Board crafted the
rules to more efficiently and effectively implement the Illinois Environmental Protection Act
(415 ILCS 5/1
et. seq.
(1998)) and other laws. Upon final adoption, these rules will replace
the Board’s existing procedural rules and relevant resolutions.
The Board originally published a proposal for public comment in docket R97-8. In its
first notice proposal, the Board made numerous changes on its own initiative and in response to
public comment. To avoid confusion with R97-8, the Board has closed that docket and opened
this new docket R00-20.
Hearings
Two hearings are scheduled in R00-20 (see Notice of Hearings). The purpose of these
hearings is to allow interested persons to comment or ask questions about the first notice
proposal. No prefiling is required to participate, although persons who wish to speak at the
hearing are encouraged to contact the hearing officer in advance.
Public Comment
Interested persons may submit public comment to the Board on or before to June 1,
2000. For this rulemaking, a person who wishes to file a public comment must file one signed
original with the Clerk’s Office at the following address:

Web site. Persons who are unable to download from the Board’s Web site, or others who wish
to receive paper copies should complete the sign-up form attached to this order.
