These petitions seek variances from our ban on new sewer
connections within the North Shore Sanitary District
(League of
Women Voters
v.
NSSD,
#
70—7, March
31,
1971).
Since they were
filed we have granted the District authority to permit
a number
of additional connections to the Clavey Road and Waukegan
sewage treatment plants,
to which
the sewers in the present
cases are tributary, on the basis
of improvements
to the treat-
ment facilities at those plants.
The petitioners are therefore
free
to apply to the District for permits to connect to the
sewers.
Until they have done so and for some unforeseeable reason been
refused, there is no need for
a variance since
a permit, for
all the petitions tell us,
can be issued without
a variance.
The petitions are dismissed as moot in light of
the variance
granted the District
in
