ORDER
On October 17, 1972 in PCB 72-243 we ordered that Jerry Frye
close his landfill if he has not obtained a permit for its operation
in 45 days.
Jerry Frye now requests a 90 day extension of time to
permit him to comply with necessary requirements for the issuance of
a permit.
It is indicated in the Petition that soil tests could not
be obtained within the time provided by our October 17, 1972 Order.
Since the EPA has apparently been in contact with Jerry Frye
regarding the issuance of
a permit. and the engineering requirements
we request that the Agency submit its recommendation on an expedited
basis by December 22,
1972.
