Environmental Protection Agency (“Illinois
EPA”), by and through its attorney, Special Assistant Attorney GeneralMichelleM. Ryan, pursuant
to 35 Ill. Adm. Code 108.402, and respectfully states as follows:

2003, Illinois
EPA issued an
Administrative Citation to Respondent
Denny Richey, based on
an inspection conducted on April 29, 2003.

On June 23, 2003, Illinois EPA sent a copy ofthe Administrative Citation to Police
ChiefMeeks ofthe West TerreHaute Police Department forhand delivery.
Personal servicewasnot
achieved within the 60 day time frame.

Because Denny Richey was not timely served within 60 days as requiredby 415
ILCS
5/31.1(b),
this Administrative Citation should be dismissed.
WHEREFORE, the Illinois Environmental Protection Agency requests that theBoard dismiss the
