PROPOSED SDWA USEPA AMENDMENTS

The Illinois Environmental Protection Agency (“Agency”) submits the following

comments on the amendments proposed by the

Illinois Pollution Control Board (“Board”) in its

opinion and order dated October 7, 2004, in the above-captioned matter.

The Board proposed an amendment to 35 Ill.

Adm. Code 61 1.956(d)(2) that removes the

last two sentences ofthat subsection. The federal equivalent to 35

Ill. Adm. Code 611

.956(d)(2)

is 40 C.F.R. §141.563(b). When the United States Environmental Protection Agency

(“U.S.

EPA”) amended 40 C.F.R.

§

141.563(b) in 69 Fed. Reg. 38850,

38856 (June 29, 2004), the U.S.

EPA removed only the last sentence.

Accordingly, the Agency requests that the Board restore the following sentence to 35 Ill.

Adm. Code 611

.956(d)(2):

The self-assessment must consist ofat least the following components:

assessment of filter performance, development of a filter profile, identification

and prioritization of factors limiting filter performancc, assessment of the

applicability ofcorrections, and preparation of a filter self-assessment report.
