    IN THE MATTER OF: )
    )
PETITION OF PRAIRIE MATERIAL ) AS 01-10
SALES, INC. FOR AN ADJUSTED ) (Adjusted Standard – Land)
STANDARD FROM 35 ILL. ADM. CODE )
    PARTS 811 AND 814 )

    HEARING OFFICER ORDER

On April 22, 2004, all parties participated in a telephonic conference with the hearing
officer. The petitioner represented that it has been working on various revised draft consent
orders on a related matter in circuit court with the Illinois Attorney General’s Office. The
petitioner anticipate that if the consent order is agreed upon and entered in the related
enforcement matter, there will be no need for the adjusted standard petition to go forward.

The Illinois Environmental Protection Agency, however, does not share the petitioner’s
belief and requested that this matter be scheduled for hearing.

The parties were directed that if the above-captioned matter is not resolved in the next 60
days, they are to propose possible hearing dates in July and/or August 2004.

The parties are directed to participate in a telephonic status conference on June 17, 2004,
at 11:30 a.m. The conference shall be initiated by the petitioner, but each party is nonetheless
responsible for its own appearance. At the conference, the parties must be prepared to discuss
the status of the above-captioned matter and their readiness for hearing.

    IT IS SO ORDERED.
