Opinion and Order of the Board

The revision of SWB—lO consisting of the addition of the Village of
Shawneetown
to the waste facilities timetable
was
proposed at the request
of
the Federal Environmental Protection Agency.
Rules
and Regulations
SWB~IOcontrols discharges only to the Ohio River mainstream.
Subsequent
to the scheduling of
a hearing on this matter the Board
received
a communication from Mr.
Robert Gates
of the Illinois
Environmental Protection Agency which conclusively demonstrated that
both Shawneetown’s
sewage treatment plant and sewage lagoon discharge to
an unnamed creek which is an infrastate tributary
to the Ohio River at
a
point about
3 1/2 miles away from the Ohio River
itself,
For
this reason
the Shawneetown waste discharges are subject
to Rules and Regulations
SWB-14 which cover intrastate waters and not SWB-~lO
Accordingly proposal
R 7l~l3is dismissed and
the hearing canceled.
