Petitioner, Village
of Bensenville files this motion
to
extend the time to
file its~
amended petition and states in support as follows:
1.
Petitioner filed its initial Petition on January 3,
2005.
The Board issued an
Order on January
20,
2005,
accepting the Petition but
requesting the Petitioner provide
additional information. The Board further requested that an amended Petition be filed by
February
18,
2005.
2.
After receiving the Board Order, Petitioner also received a communication
from
the Illinois
Environmental
Protection
Agency
suggesting
that
the
IEPA
believed
that other additional information should be provided to the Board.
3.
In order
to
respond to
these requests,
Petitioner is
currently preparing an
amended Petition. It will not be ready for filing by the date specified
in the Board Order.
Petitioner requests that the date be extended by
14 days until March 4, 2005.
4.
Counsel for the IEPA indicated that she had no objection to this extension
request and no other person has filed an appearance in this matter. This extension will not
prejudice any
otherperson.
