ORDER OF THE BOARD
(by J. Anderson):
On July
19,
1993,
Spraying Systems Company
(SSC)
and the
Illinois Environmental Protection Agency
(Agency)
filed a joint
status report.
The filing comes in response to an April
8,
1993
Board order directing the parties to file a status report by july
19,
1993.
In their status report,
the parties state that,
on August
3,
1992,
SSC submitted a proposed RCRA Closure Work Plan for
additional subsurface investigation at the site.
The Agency
reviewed the work plan and provided comments to SSC on april
1,
1993.
On April 22,
1993,
SSC met with the Agency to discuss the
work plan.
As
a result of the discussion,
the Agency
approved
the work plan in May 1993.
SSC has commenced activities pursuant
to the work plan and anticipates that the plan will be completed
in September 1993.
Within the last week,
the Agency has suggested a possible
way of resolving this matter.
The parties assert that,
in light
of this latest development as well as the fact that the
additional site investigation
is proceeding,
they are “optimistic
about the prospects for settlement.”
The parties also assert
that any settlement
is expected to resolve most,
if not all,
of
the issues in this matter.
In light of the above, the Board directs the parties to file
an updated status report to be received by the Board no later
than September
6,
1993.
The Board
is unable to grant any further
extension in the absence of a waiver of the December 31,
1993
decision deadline.
