ORDER OF THE BOARD (by E. Dunham):
On October 2, 1996, the Board received a letter from Courtice Bowman of Upchurch
& Associates. Mr. Bowman is the project coordinator for Effingham Tire Center and has filed
an appearance on behalf of the petitioner. The letter stated that the parties have reached a
resolution and that petitioner would like to dismiss the case. The Board construes this letter as
a motion to withdraw the appeal. The Board hereby grants the motion to withdraw and closes
this docket.
IT IS SO ORDERED.
Section 41 of the Environmental Protection Act (415 ILCS 5/41 (1994)) provides for
the appeal of final Board orders within 35 days of the date of service of this order. The Rules
of the Supreme Court of Illinois establish filing requirements. (See also 35 Ill. Adm. Code
