ORDER OF THE BOARD (by C.A. Manning):
On September 5, 2002, the Board issued an order finding that Tony Luttrell (Luttrell)
violated Section 21(p)(7) of the Environmental Protection Act (Act) (415 ILCS 5/21(p)(7) (2000)
as amended by
P.A. 92-0574, eff. June 26, 2002) by causing or allowing the open dumping of
waste in a manner resulting in the deposition of construction or demolition debris. The Board’s
order stated that the facility was located northeast of Xenia at approximate coordinates 360N and
360E in Clay County.
On September 20, 2002, the Illinois Environmental Protection Agency (Agency) filed a
motion to amend the final opinion and order. The Agency states that the actual location of the
site is southwest of Xenia at approximate coordinates 125N and 210E. While the coordinates
were listed incorrectly in the citation, the Agency states that its site code number was correct,
and the location was correctly identified in the inspection report. Luttrell has not responded to
this motion.
The Board grants the Agency’s motion to amend the final order with respect to the
coordinates of Luttrell’s facility. The coordinates of Luttrell’s facility appear in the opinion
portion of the Board’s September 5, 2002 opinion and order. This correction does not affect the
Board’s September 5, 2002 default order against Luttrell.
