This matter comes before the Board on a January
13,
1992
motion for additional time to answer Chicago Heights Refuse
Depot,
Inc.’s
(Refuse Depot) request for stay,
filed by the
People of the State
of Illinois (State).. On January
3,
1992, the
Refuse Depot filed a request for stay of the Board’s October
10,
1991 and December
6,
1991 Orders.
A response to the request for
stay was due January 13,
1992,
accounting for mailing delays.
State requests the additional
time, until January 28,
1992,
due
to the complexity of the issues involved
in the request for stay.
The Refuse Depot has not yet filed a response to the motion for
additional time.
Ordinarily, the Board would hold the motion filed January
13,
1992,
for
11 days
(to January 24,
1992)
to allow for response
and mailing time.
Consequently, the next earliest opportunity
for the Board to act on the January 13 motion would be the
regularly scheduled Board meeting on February
6,
1991.
To
prevent undue delay,
the Board will rule on this motion today.
The motion for additional time is granted.
The response to
the motion for stay
is to be filed no later than January 28,
1992.
