ORDER OF THE BOARD (by T.E. Johnson):

On December 19, 2002, at the parties’ request, the Board extended until March 2, 2003,
the time period for Tri-Town Service, Inc. (Tri-Town Service) to appeal an October 28, 2002
determination of the Illinois Environmental Protection Agency (Agency).
    See
    415 ILCS
    5/40(a)(1) (2002); 35 Ill. Adm. Code 101.300(b), 105.402, 105.406. At issue is the Agency’s
approval of Tri-Town Service’s request for reimbursement of corrective action costs from the
Underground Storage Tank Fund (UST), with modifications, regarding Tri-Town Service’s UST
site at 5020 St. Charles Road, Bellwood, Cook County. Because petitioner failed to timely file
an appeal, the Board dismisses this case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on June 5, 2003, by a vote of 6-0.

    Dorothy M. Gunn, Clerk
