On July 29,
1992, Stepan filed a status report in this matter.
This
matter
is
inter-related
with
federal
regulations
in
the
Federal Implementation Plan
(FIP).
Among
other
things,
Stepan
reports that on July 9,
1992, USEPA filed a status report
in the
United States Court of Appeals for the Seventh Circuit pertaining
to Stepan’s appeal of the federal regulations.
The USEPA status
report, which is attached hereto, states:
“In
regard
to
EPA’s
reconsideration
of
regulations
concerning
Stepan,
EPA
has
completed
its
preliminary
site—specific
analysis
of
Stepan’s
plant to determine
appropriate control requirements.
The Regional Office
has prepared a draft notice of proposed rulemaking on the
control
requirements
which
is
currently
undergoing
Regional review.
EPA projects thatthis notice will be
published in the Federal Register by February
1,
1993.”
Stepan continues to request that
t-’e Board allow this docket
to remain open.
Stepan remains concerned that it could be caught
between
conflicting
state
and
federal
regulations
should
this
proceeding go forward or be dismissed before the federal rulemaking
is finalized and the federal appeal is resolved.
Stepan
is directed to filed an updated status
report on
or
before December
1,
1992.
