HEARING OFFICER ORDER

 

On June 23, 2005, the petitioner informed the hearing officer that it will contact the

respondent to determine the status of the above-captioned matter. At the April 14, 2005,

Telephonic status, the petitioner informed the hearing officer that revised operating permit is

being reviewed and, that if approved, will resolve this matter. Once resolved, the petitioner

anticipates that it will be filing a motion for voluntary dismissal for the above-captioned matter.

The petitioner represented that it will file a 60-day waiver of the statutory decision deadline.

 

The parties are directed to participate in a telephonic status conference with the hearing

officer on August 25, 2005, at 9:00 a.m. The status conference must be initiated by the

petitioners, but each party is nonetheless responsible for its own appearance. At the status

conference, the parties must be prepared to discuss the status of the above-captioned matters and

their readiness for hearing. If, however, motions to dismiss the respective matters are filed prior

to the next status conference, the conference will be cancelled without further order.
