ORDER OF THE BOARD

On July 23,
1993
City of Ottawa
(City)
filed a motion for
further modification of two completion dates associated with the
grant to the City of an exception to the Board’s combined sewer
overflow regulations.
The dates in question are for completion
of Phases II and III of the City’s sewer separation program.
The
dates are set forth in conditions 2(b)
and
(c)
of the original
August
4,
1988 order,
as initially modified by the Board on March
26,
1992:

The City will construct Phases
I,
II, and III
of its sewer separation program,
as
summarized below and further described
in
Alternate
6 of the petition:
b)
Phase II, which consists of a total
of 19,570 lineal feet of storm
sewer construction in the
Northeast, Northwest,
and South
Sectors,
shall be completed by
FcbruaryNovember
1,
1993.
c)
Phase III, which consists of a
total of 3,380 lineal feet of storm
sewer construction in the South
Sector,
shall
be completed by
ScptcmberDecember
1,
1993.
The City requests that the dates at 2(b) and
(C)
now be
extended to July
1,
1994 and November
1,
1994, respectively.
The
motion lists various reasons for the extensions,
including the
need to re—design portions of the two projects and unanticipated
delays in obtaining easements and Illinois Department of
Transportation approvals.
The City contends that the extensions
of time would not cause environmental harm.

On August
5,
1993 the Illinois Environmental Protection
Agency
(Agency)
filed a response to the City’s motion.
The
Agency moves that the Board grant the City’s requested extension
of dates.
The Agency observes that the Phase II and III projects
are funded by a grant administered by the Agency, and that the
Agency is aware of the situations the City has faced and believes
that the extensions of time are warranted.
The Agency further
agrees with the City that the extensions of time would not cause
environmental harm.
The motion for modification
is hereby granted.
The
completion dates listed in conditions 2(b) and
(c)
of the Board’s
August
4,
1988 grant of exception to the combined sewer overflow
regulations are hereby extended to July
1,
1994 and November
1,
1994,
respectively.
