    ORDER OF THE BOARD
    (by R.
    C.
    Fleinal):
    On August
    13,
1992, the Board ordered the parties in this
proceeding to submit a status report.
    A joint status report and
    motion for additional time
(joint report) was received by the
    Board on August
    27,
    1992.
The joint report states that as a
result of consultations between the Illinois Environmental
    Protection Agency
(Agency), Rock Island, and the Illinois
    Department of Conservation
(DOC)1, Rock Island has agreed to
    retain a consulting firm,
    ECOSEARCH, Inc.,to conduct a field
survey and perform acute toxicity testing.
    Upon completion of
the ECOSEARCH report, Rock Island will submit copies to the
    Agency and DOC for review.
    In its August
    13,
    1992 order,
    the Board further noted that
the Agency received an extension until April 29,
    1992 to file its
response to the petition, and that no response has been filed.
In the joint report, the Agency further requests that the Board
grant the Agency “up to 60 days after receipt of the
    ECOSEARCH)
report to file its response in this matter”.
    (joint report at
    2.)
    The Board notes that there
is no indication in the joint
report of a timetable for the submission of the ECOSEARCH report.
    In addition, absent a waiver,
this matter is due for decision by
    the Board at its December
    17,
    1992 meeting.
    Under these
circumstances, the Board cannot grant the additional time as
    requested.
The Agency’s motion is granted in part.
    The Agency
shall submit its response to the petition by October
    9,
    1992.
This will allow sufficient time for review and hearing prior to
the Board’s decision on the matter.
