    This matter is before the Board pursuant to a status report
    filed by Reynolds Metal Company
    (Reynolds) on September 8,
    1994.
    On March 31,
    1994, we extended the stay in this case until
    Thursday,
    September
    15,
    1994 while Reynolds awaits U.S. EPA’s
    final promulgation of a site specific control requirement for
    Reynold’s aluminum rolling operations.
    We asked petitioner to
    file an updated status report addressing the U.S.EPA’s progress
    either on or before Thursday, September
    8,
    1994,
    or file the
    appropriate motion if the U.S. EPA finalizes the rule.
    Petitioner’s last status report stated that U.S.EPA
    personnel informed Reynolds that U.S.EPA Region V intended to
    forward the proposed rule to U.S.EPA Headquarters in May or June
    of 1994 for finalization.
    The projected publication date for the
    final rule would have then been at the end of this summer.
    The
    September 15 status report states that U.S.EPA informed Reynolds
    that it now intends to publish the final rule around October 31,
    1994.
    As such, Reynolds is requesting an extension of the stay
    beyond September 15,
    1994.
    Reynolds’ motion is hereby granted. The stay in this matter
    shall be extended until December
    1,
    1994.
    Reynolds is directed
    to file a status report on or before Thursday, November 17,
    1994
    indicating the status of the federal rule.
    If, however, the rule
    is finally promulgated before November 17,
    1994, Reynolds is
    requested to file the appropriate motion.
