ORDER OF THE BOARD (by M.E. Tristano):
This matter is before the Board on the complainants’ motion to withdraw their complaint.
On March 18, 2002, David L. Weber and Rachel B. Weber (complainants) filed a noise pollution
complaint against Cisco United Methodist Church (respondent). On January 13, 2003,
complainants filed a motion to withdraw their noise pollution complaint. Complainants state that
on January 3, 2003, they sold the remaining property located at lots 3 and 4 of Block 5 in the
town of Cisco. As a result, the complainants state they are no longer personally affected by the
noise nor do they have a need to protect the value or salability of the property in Cisco. Having
“lost their motivation to continue the case,” complainants filed a request to withdraw their
complaint against respondent.
The motion to withdraw the complaint is granted, and this case is dismissed.
IT IS SO ORDERED.
