On September 12,
1994,
complainants filed a letter with the
Board.
In the letter,
the complainants state that they were out
of town and therefore were not aware of the respondent’s August
8,
1994 motion for summary judgment until the first week in
September.
Complainants further state that they believe that
they have 30 days following receipt of the respondents filing in
which to respond.
The complainants characterize the letter as a
response to the respondent’s motion for summary judgment.
On September
1,
1994, the Board granted the respondent’s
motion for summary judgment.
The Board’s procedural rules allow
7 days after service of a motion for the filing of a response to
the motion.
(35 Ill. Adm. Code 101.241.)
The Board will construe
the current filing by complainant as a motion for reconsideration
because the letter was filed after the
7 day period to respond
had lapsed and after the Board had issued its order on the
motion.
A response to a motion for reconsideration shall be filed
within
14 days from the filing of the motion.
(See 35 Ill. Adm.
Code 101.246(b).)
The Board will not rule on the complainants’
motion for reconsideration until after the time for a response
has expired.
