BOARD

Manning):
On September 5,
1991, General Motors Corporation, Electro-
Motive Division
(“GM”) filed a petition for an air variance for
its facility located in LaGrange, Illinois.
Pursuant to
our
order of January 20,
1994, GM and the Illinois Environmental
Protection Agency (“Agency”) filed a joint status report on April
14, 1994.
On September 15,
1992, GM submitted comments to the U.S. EPA
regarding the proposed federal rule applicable to GM’S locomotive
coating operations. Since that time, the parties have been
submitting reports to us on the status of this case while U.S.EPA
considers GM’S comments.
On March 25,
1994, U.S.
EPA
published
the final rule in the federal register with an effective date of
April 25,
1994.
Previously, the parties have stated that a hearing in this
matter may be unnecessary; they still believe this to be the
case.
The parties request until May 16,
1994 to file a status
report while they determine the next step.
Accordingly,
the parties are directed to file a status
report on or before May 16,
1994.
In addition to reporting the
parties’ status on this matter, they shall also indicate whether
a hearing will be necessary.
