    ORDER OF THE BOARD (by S.T. Lawton):
     
    On May 4, 2001, the People of the State of Illinois filed a three-count complaint against
    respondents, Marc Development Corporation (MDC) and Silver Glen Estates Homeowners’
    Association (Silver Glen). The complaint alleges MDC and Silver Glen failed to properly use
    and maintain a surface spray irrigation wastewater disposal system facility at the Silver Glen
    subdivision development, located off of Whispering Trails Road in Elgin Township, Kane
    County, Illinois, in a manner resulting in violations of operation and construction permits and
    water provisions under the Environmental Protection Act (Act) and Board’s regulations. These
    activities were specifically in alleged violation of Sections 12(a), 12(b), and 12(f) of the Act
    (415 ILCS 5/12(a), 12(b)) (1998)), and Section 306.102(a) of the Board’s regulations (35 Ill.
    Adm. Code 306.102(a)). The Board accepts this matter for hearing.
     
    The Board directs that this matter proceed to hearing as expeditiously as practicable.
    The assigned hearing officer must set the matter for hearing in accordance with the
    requirements of the Act and the Board’s procedural rules. It is the responsibility of the hearing
    officer to guide the parties toward prompt resolution or adjudication of this matter, through
    whatever status calls and hearing officer orders he determines are necessary and appropriate.
