On February 24,
1995 the Union Oil Company of California
(Unocal)
filed a petition for variance from 35
Ill. Adm. Code
212.322 Existing Process Sources for particular matter emissions
pursuant to Section 35 of the Environmental Protection Act
(Act)
for its Chicago Carbon Plant.

(1992).)
Unocal’s
facility is located at 317 W. New Avenue, near Lemont, Illinois
and is approximately 30 miles southwest of Chicago.
The Board’s procedural rules at 35
Ill.
Adm. Code 104.121
requires specific information to be contained in
a variance
petition.
Unocal’s petition is lacking the following
information:
1)
A clear and concise statement as to the starting date
and ending date of the requested variance.
2)
Location of the nearest air monitoring station
maintained by the Agency.
3)
An assessment, with supporting factual information,
of
the environmental impact that the variance will impose
on human,
plant, and animal life in the affected area,
including,
where applicable,
data describing the
existing air quality which the discharge may affect.
4)
Past efforts to achieve compliance including costs
incurred,
results achieved and permit status.
Such supplemental petition containing at a minimum the above
information, or any other appropriate motion,
shall be filed with
the Clerk of the Board on or before April
14,
1995.
Failure to
do so will subject this matter to dismissal.
