ORDER OF THE BOARD
(by M. Nardulli):
This matter comes before the board on an April 17, 1992 joint
motion to extend the hearing date in this matter until the week of
August 24,
1992.
The motion asks that the Board vacate its April
9,
1992 order which directed that the hearing officer
set this
matter for hearing by May 11,
1992.
The parties assert that a waiver
is on file with the
Board
until October 30, 1992.
Additionally, the parties assert that they
will not have time to adequately prepare for and attend the hearing
in accordance with the
Board
order.
Finally,~the parties have
consulted with the
hearing
officer,
and
a
hearing
can
not
be
scheduled until, the week of August 24.
Therefore, the Board will
reconsider its order of April
9,
1992,
and the Board will vacate
the order
setting this case
for hearing.
The Board directs the
parties to submit a status report to be received by the Board no
later than June 15, 1992.
The Board notes that the June 15,
1992
date will allow the Board the time necessary to hold
a hearing
prior to the October 30,
1992 decision deadline,
if a hearing is
necessary.
If petitioner chooses to waive the Board’s decision
deadline
for
a
suitable
period,
the
hearing
officer
will
be
authorized to schedule the hearing for the week of August 24, 1992.
