OF
THE
BOARD

On
March
30,
1994,
American
Waste
Processing,
Ltd.
and
the
Environmental Protection Agency (Agency)
filed a joint motion to
stay review of this matter until June 30,
1994.
The last hearing in this matter was held on February 23,
1994 and the petitioner’s reply brief was filed on August
11,
1993.
As a result of the hearings and briefs, the parties are in
agreement that it is in the best interest of all concerned for
the Agency to further review this matter.
Petitioner has filed a
new permit application with the Agency.
The Agency
is presently
reviewing the application.
The parties also note that an open
waiver of the decision deadline has been provided by the
petitioner.
Therefore, the parties request that the Board stay
its review of the record in this matter until after the Agency
has completed its review of the new permit application.
The Board notes that this case was begun in 1991 and this is
the third motion for stay filed in this matter.
The Board is
averse to allowing cases to linger indefinitely.
However, the
Board agrees that completion of the review of the new permit
application by the Agency prior to the Board’s review of the
record in this matter is in the best interest of all parties.
Therefore, the Board grants the motion to stay review of the
record in this matter until after June 30,
1994.
