ORDER OF THE BOARD
(by
J. Theodore Meyer):
On January 4,
1994, petitioner
CWM
Chemical Services,
Inc.
(CWM)
filed a status report in this proceeding.
The status
report is in response to the Board’s April 23,
1992 order staying
this permit appeal.
As part of that stay,
the Board ordered
CWM
to file a status report every 90 days.
This status report recounts the progress being made by
CWM
and the Illinois Environmental Protection Agency (Agency) on the
Agency’s review of CWM’s November 1991 RCRA Part B permit
application.
CWN
states that it has met with the Agency, and
that it has supplied the Agency with additional information.
CWM
states that it anticipates Agency approval of the Part B permit
in early 1994.
The Board accepts the status report.
However, we must note
our
concern with the progress of this case.
Although we
recognize that review of a Part B permit is a lengthy process,
the application has now been pending at the Agency for over two
years.
The Board reminds
CWM
that it has a continuing obligation
to submit status reports every 90 days.
IT IS SO ORDERED.
