ORDER OF THE BOARD (by T.E. Johnson):
On April 14, 2003, the petitioner filed a motion for voluntary dismissal in this matter. In
the motion, the petitioner represents that it filed another permit application following settlement
discussion between the parties that will resolve this appeal. The petitioner asserts that all issues
between the parties have been resolved, and requests that the Board dismiss the petition for
review.
To date, the Agency has filed no response to the motion. Pursuant to Section 101.500(d)
of the Board’s procedural rules, if no response is filed to a motion within 14 days after service,
the party will be deemed to have waived objection.

petitioner’s motion to dismiss is granted, and the docket is closed.
