ORDER OF THE BOARD
(by R. C. Flemal):
On December 29,
1994,
LTV
Steel Company
(LTV)
and the
Illinois Environmental Protection Agency (Agency) filed
a joint status report.
The status report was due to be filed on
or before November 18,
1994 pursuant to Board order of July 21,
1994.
LW also filed a motion that the report be accepted
instanter,
stating that ongoing negotiations with the Agency and
the Chicago Legal Clinic delayed its filing.
The Board grants
the motion to file instanter.
LW and Acme Steel Company filed a petition for an adjusted
standard on March 24,
1994, docket AS 94-8.
The parties report
that on August 31,
1994, LTV filed a petition to revise the
relief requested in AS 94-8.
On November 28,
1994 the Agency
filed its recommendation that the revised relief be granted.
If
the adjusted standard in AS 94-8 is granted,
it would obviate the
reason for this permit appeal.
LW requests that the matter be
stayed for another 180 days.
An open waiver was previously filed
in this proceeding.
The Board grants the motion to stay and directs the parties
to file a status report with the Board and hearing officer not
later than May 10,
1995 in the event that this matter has not
already been resolved and dismissed.
