HEARING OFFICER ORDER

 

On April 8, 2004, all parties participated in a telephonic status conference with the

hearing officer. Respondent represented that it is awaiting comment from the United States

Environmental Protection Agency regarding permit notice. Respondent anticipates comment in

the near future. If approved, the petitioner anticipates filing a motion to voluntarily dismiss this

matter. Petitioner represented that it will file a 40-day waiver of the statutory decision deadline.

 

The parties are directed to participate in a telephonic status conference with the hearing

officer on May 13, 2004, at 1:45 p.m. The status conference must be initiated by the petitioner,

but each party is nonetheless responsible for its own appearance. At the status conference, the

parties must be prepared to discuss the status of the above-captioned matter and their readiness

for hearing. If, however, the petitioner files a motion to dismiss prior to the next status

conference, the conference will be cancelled without further notice.
