    ORDER OF THE BOARD

    This matter is before the Board on a motion to file the
    record instanter,
    filed by the Illinois Environmental Protection
    Agency
    (Agency) on January 26,
    1995.
    Petitioner USA Waste of
    Illinois
    (USA Waste)
    filed its petition on October 31,
    1994, and
    the Agency received notice of the petition on October 31,
    1994.
    The Agency was required to file the record within 14 days of
    receiving notice of the petition, or by November 14,
    1994.
    The
    record
    is therefore seventy—three days late.
    The Agency states
    that the delay was caused by the press of Agency business, and
    that it believes no prejudice will result from the delay.
    The motion to file instanter is granted.
