This matter is before the Board pursuant to
complainant’s motions filed on
February 20
and March
18,
1996,
to extend time
to
file her post-hearing brief.
On May
5,
1994
Dorothy
L.
Hoffman filed this citizen’s enforcement complaint before
the Board against respondent,
the
City of Columbia.
The complaint alleged that
respondent violated
415
ILCS
5/23
and 5/24 of
the Environmental Protection
Act (Act) and
35
111.
Adm.
Code 900.102.
On June 2,
1994 the
Board found this matter was not frivolous or duplicitous and sent it to hearing.
Complainant,
on February 20,
1996,
requested an extension of three weeks which the
Board
had not ruled on due to the misunderstanding between itself and the assigned Hearing
Officer.
In the more recent motion,
the complainant
is requesting
for an additional week
to
file.
The
respondent has not filed a response to either of the requests.
On March 28,
1996
the
complainant filed her post-hearing brief.
The Board grants the complainant’s requests and accepts
the brief as timely filed.
Since the hearing officer originally provided the respondent six (6) weeks to
file its brief, the
respondents brief is now due May 16,
1996 and complainant’s rebuttal brief is due May 30,
1996.
