ORDER OF THE BOARD
(by
J.
Theodore Meyer):
On March 25,
1994, petitioner Acme Steel Company
(Acme)
filed a status report in this proceeding.
This status report is
in response to a February 3,
1994 Board order, directing Acme to
file a status report by March 25.
Acme again states that it is working with the Illinois
Environmental Protection Agency (Agency)
in pursuing permanent
relief from the standards at issue in these appeals.
Acme states
that it filed a petition for adjusted standard with the Board on
March 24,
1994.
Acme states that if granted, that petition
(docketed as AS 94-8) would resolve the permit appeals with
regard to thermal permit limitations.
Acme further states that
the Agency is currently considering Acme’s proposal to resolve
the other challenged permit conditions.
Acme recommends that
this matter be stayed for 90 days pending resolution of the
adjusted standard petition.
As we have previously stated, we will not let this case
linger indefinitely.
However, because Acme has now filed its
petition for adjusted standard, and because there is apparently a
proposal for settlement of the other outstanding issues, we will
grant a 120-day stay of proceedings.
We have extended the time
beyond the 90 days requested by Acme with the expectation that
Acme will do all in its power to assure that the adjusted
standard petition proceeds to decision as rapidly as possible.
Acme is directed to file an additional status report no later
than August
1,
1994.
IT IS SO ORDERED.
