ILLINOIS POLLUTION CONTROL BOARD
July 22,
1993
PEOPLE OF THE STATE OF ILLINOIS,
)
Complainant,
PCB 91—157
v.
)
(Enforcement)
)
THE GRIGOLEIT COMPANY,
Respondent.
ORDER OF THE BOARD
(by J.
Anderson):
On June
4,
1993, The Grigoleit Company (Grigoleit) and the
People of the State of Illinois (People)
filed a joint status
report and a motion to continue.
The filing comes in response to
the Board’s June 17,
1993 order directing the parties to file
status reports with the Board by July 16,
1993.
In their status report, the parties request the Board to
continue this matter to allow the parties to conduct a settlement
meeting and to order the parties to file, by August
16,
1993,
either a hearing request,
a request for waiver of hearing,
or a
notification that settlement
is not possible.
In support of their request, the parties assert that they
have agreed to enter into negotiations in this matter.
A meeting
has been scheduled for July 26,
1993.
At that meeting, the
parties intend to either reach, an agreement as to settlement
terms or determine that settlement cannot be reached.
If an
agreement is reached, the parties,
by August
16,
1993, will
either request the hearing officer to schedule a settlement
hearing or request a waiver of such hearing.
If an agreement
cannot be reached, the parties will notify the Board,
by August
16,
1993,
that settlement is not possible.
The Board notes that this
is the seventh motion to continue
this matter for the purpose of settlement negotiations.
In the
interests of administrative economy,
however, the Board accepts
the status reports and grants the parties’ request to continue.
The Board cautions the parties, however, that it will not
continue this matter indefinitely and that it expects the parties
to expeditiously pursue a resolution of this case.
The parties
are directed to file one of the aforementioned documents in this
matter no later than August 16,
1993.
IT IS SO ORDERED.
