ORDER OF THE BOARD

Anderson):
On January 29,
1993, the People of the State of Illinois
(People) filed a motion asking the Board to stay its Board’s
January 21,
1993 interim order in this matter for 30 days.
In that order, the Board granted the People’s motion to strike
certain affirmative defenses asserted by Cheiu—Plate Industries,
Inc.
(Chem-Plate).
The Board also granted the People’s motion
for summary judgment and found that Chem-Plate violated Section
21(i)
of the Environmental Protection Act and 35
Ill.
Adm. Code
722.141
(i.e.,
the annual reporting requirement for generators of
hazardous waste who ship waste off—site).
In support of the motion, the People assert that the parties
have agreed to a settlement and are now in the process of
collecting the required signatures.
The People also assert that
both parties wish to inform the Board of the same as to avoid
wasting resources.
The Board hereby grants the motion for stay until March 8,
1993.
