Federal Update
United States Environmental Protection Agency Adopts Filter Backwash Recycling Rule in Final Rule under Safe
Drinking Water Act
On June 8, 2001, USEPA adopted the Filter Backwash Recycling Rule (FBRR) in a final rule. 66 Fed. Reg. 31085.
The purpose of the FBRR is to further protect public health by requiring public water systems (PWS), where needed,
to institute changes to the return of recycle flows to a plant’s treatment process that may otherwise compromise
microbial control. The final rule addresses a statutory requirement of the Safe Drinking Water Act Amendments of
1996 (42 U.S.C. §§ 300f
et seq
. (1998)) to promulgate a regulation which governs the recycling of filter backwash water
within the treatment process of a PWS.

In response to this USEPA action, the Board will include any necessary amendments to its drinking water rules in an
upcoming identical in substance rulemaking pursuant to Sections 7.2 and 17.5 of the Environmental Protection Act
(415 ILCS 5/7.2, 17.5 (2000)).
United States Environmental Protection Agency Withdraws Two Provisions from Direct Final Rule for Standards of
Performance for Electric Utility Steam Generating Units for Which Construction is Commenced after September
18, 1978, and Standards of Performance for Industrial-Commercial-Institutional Steam Generating Units Under
the Clean Air Act
On June 11, 2001, USEPA partially withdrew portions of the direct final rule published on April 10, 2001 for Subpart
Da - Standards of Performance for Electric Utility Steam Generating Units for Which Construction is Commenced
After September 18, 1978, and Subpart Db - Standards of Performance for Industrial-Commercial-Institutional Steam
Generating Units (66 Fed. Reg. 18546) as a result of receiving relevant adverse comment. 66 Fed. Reg. 31177 (June 11,
2001). These New Source Performance Standards (NSPS) provisions deal with the revised definition of “boiler
operating day” and the data substitution requirement for missing data.
The withdrawal became effective June 11, 2001. The remaining provisions published on April 10, 2001, will also
become effective June 11, 2001, as stated in the April 10, 2001 direct final rule. For further information contact James

Pursuant to Section 9.1(b) of the Environmental Protection Act (Act) (415 ILCS 5/9.1(b) (2000)), once adopted by
USEPA, NSPS rules are applicable and enforceable under the Act without further action by the Board. This
withdrawal action would be similarly applicable without further action of the Board.
United States Environmental Protection Agency Proposes Revisions to the Federal NOX Budget Trading Program,
the Emissions Monitoring Provisions, the Permits Regulation Provisions, and the Appeal Procedures under the
Clean Air Act
On June 13, 2001, USEPA proposed revisions to the federal NOX budget trading program, emissions monitoring
provisions, permit regulation provisions, and appeal procedures for the NOX program. 66 Fed. Reg. 31977.
USEPA is proposing rule revisions that would modify the existing requirements for sources affected by the Federal
NOX Budget Trading Program, the Acid Rain Program, and the October 27, 1998 NOX SIP Call. The proposed
revisions are designed to streamline and add flexibility to the monitoring and reporting requirements in response to
the significant changes that have occurred in power generation in recent years. These changes are due both to
deregulation and recent environmental actions initiated by USEPA to reduce nitrogen oxides emissions. The
proposed action would also make certain technical corrections, remove outdated provisions, and correct printing,
typographical, and grammatical errors to correct or clarify cross references, and, in a few instances, to ensure that the
specific rule language is consis tent with USEPA’s intent.
Comments must be received by July 30, 2001. Anyone requesting a public hearing must contact USEPA by June 25,

If USEPA adopts these proposed rules, and amendments to the Illinois air rules become necessary, the Board would
expect the Illinois Environmental Protection Agency to propose amendments using the Clean Air Act “fast-track”
procedures at Section 28.5 of the Environmental Protection Act (415 ILCS 5/28.5 (2000)).
United States Environmental Protection Agency Proposes Requirements for Small Municipal Waste Combustion
Units Constructed before August 30, 1999 under the Clean Air Act
On June 14, 2001, USEPA proposed federal plan requirements for small municipal waste combustion (MWC) units
constructed on or before August 30, 1999. 66 Fed. Reg. 32483.
On December 6, 2000, USEPA adopted emission guidelines for existing small MWC units. Existing small MWC units
are those units on which construction was commenced on or before August 30, 1999. Sections 111 and 129 of the
Clean Air Act (CAA) (42 U.S.C. §§ 7401
et seq
. (1998)) require states with existing small MWC units subject to the
emission guidelines to submit plans to USEPA that implement and enforce the emission guidelines. State plans are
due from states with small MWC units subject to the emission guidelines on December 6, 2001. If a state with
existing small MWC units does not submit an approvable plan within two years after promulgation of the emission
guidelines (December 6, 2002), Sections 111(d) and 129 of the CAA require USEPA to develop, implement, and
enforce a federal plan for small MWC units located in that state.
The June 14, 2001 USEPA action proposes a federal plan to implement emission guidelines for small MWC units
located in states without USEPA approved and effective state plans. The federal plan, when finalized, will be an
interim action because on the effective date of an approved state plan, the federal plan will no longer apply to small
MWC units covered by the state plan.
Comments on the proposal must be received by August 13, 2001. A public hearing will be held if requests are

Rule Update
Board Adopts Second Notice Proposal in Proposed Regulated Recharge Area for Pleasant Valley Public Water
District, Proposed Amendments to 35 Ill. Adm. Code Part 617, R00-17
On June 7, 2001, the Board proposed amendments to 35 Ill. Adm. Code Part 617 for second notice review by the Joint
Committee on Administrative Rules. The proposed rules would create a regulated recharge area for the Pleasant
Valley Public Water District in Peoria County, Illinois. The Pleasant Valley proposal is the first regulated recharge
area proposal brought to the Board, and its adoption would create the State’s first regulated recharge area.
The Board’s second notice proposal follows substantially the proposal filed by the Illinois Environmental Protection
Agency (Agency) on February 14, 2000. The Board adopted first notice rules on August 10, 2000 that were
published in the
Illinois Register
on August 30, 2000. 25 Ill. Reg. 13164. The Board held a public hearing on May 9,
2000, in Peoria, Illinois. Two witnesses presented testimony at the public hearing. Seven public comments have been
filed with the Board since adoption of the first notice proposal.
Pursuant to Section 17.3 of the Environmental Protection Act (Act) (415 ILCS 5/17.3 (2000)), the Agency may propose
regulated recharge area regulations to the Board. The Agency developed its proposal in consultation with the
Groundwater Advisory Council (Council), an agency and citizen body established under the Illinois Groundwater
Protection Act (415 ILCS 55/1
et seq
. (2000)) to “review, evaluate and make recommendations regarding State laws,
regulations and procedures that relate to groundwater protection.” The Agency additionally sought and received
advice from the Central Priority Groundwater Protection Planning Region Committee (Committee), a broad-based local
government and citizen group as provided for at Section 17.2 of the Act. 415 ILCS 5/17.2(b) (2000). The Agency,
Committee, and Council conducted a pre-proposal regulatory development workshop and solicited and obtained
additional comments on the proposal from members of various environmental associations and private citizens
groups.

Board Adopts Second Notice Proposal in Proposed Amendments to Tiered Approach to Corrective Action
Objectives (TACO): 35 Ill. Adm. Code 742, R00-19(B)
On June 7, 2001, the Board proposed rules to amend 35 Ill. Adm. Code Part 742 for second notice review by the Joint
Committee on Administrative Rules. On May 15, 2000, the Illinois Environmental Protection Agency (Agency) filed a
proposal to amend the Board’s land regulations at 35 Ill. Adm. Code 742, commonly referred to as the Tiered
Approach to Corrective Action Objectives (TACO) rules. The TACO rules were originally adopted by the Board on
June 5, 1997, in Tiered Approach to Corrective Action Objectives (TACO): 35 Ill. Adm. Code 742, R97-12(A). Part 742
contains procedures for developing remediation objectives based on risks to human health and the environment
posed by environmental conditions at sites undergoing remediation in the Site Remediation Program, the Leaking
Underground Storage Tank Program, and pursuant to Resource Conservation and Recovery Act Part B permits and
closures.
On July 27, 2000, the Board moved the Agency’s proposed rulemaking to first notice. In doing so, the Board divided
the proposal into two subdockets, A and B. The first notice rules were published in the
Illinois Register
on August
18, 2000. 25 Ill. Reg. 12225. Three hearings were held in this matter during the first notice period. In addition to the
testimony and exhibits presented at hearing, the Board has also received numerous public comments in this matter.

Board Creates Docket in Proposed Amendments to Tiered Approach to Corrective Action Objectives (TACO): 35
Ill. Adm. Code 742, R00-19(C)
On May 15, 2000, the Illinois Environmental Protection Agency (Agency) filed a proposal to amend 35 Ill. Adm. Code
742 of the Board’s land regulations, commonly referred to as the Tiered Approach to Corrective Action Objectives
(TACO) rules. On June 7, 2001, the Board created this Subdocket C to address proposed clean up standards for
methyl tertiary-butyl ether (MTBE).
The Board determined that this subdocket is necessary in light of another pending Agency proposal that would add
groundwater quality standards for MTBE.

Adm. Code 620, R01-14. Additionally, the Board noted recent action in the State legislature to ban the use of MTBE
in Illinois. Specifically, the General Assembly has sent to the Governor for his action House Bill 171, which would
prohibit the use, sale, distribution, blending, or manufacturing of MTBE as a fuel additive in Illinois. If signed by the
Governor, the ban would become effective in three years.

Board Adopts First Notice Proposal in Revisions to Antidegradation Rules: 35 Ill. Adm. Code 302.105, 303.205,
303.206, 102.800, 102.810, 102.820 and 102.830, R01-13
On June 21, 2001, the Board proposed rules to amend 35 Ill. Adm. Code 302.105, 303.205, 303.206 and 102.800-830 for
first notice publication in the
Illinois Register
. On August 30, 2000, the Illinois Environmental Protection Agency
(Agency) filed a proposal for rulemaking to amend the Board’s water “nondegradation” rules to more accurately
implement the required federal concepts of antidegradation and outstanding resource waters for the State of Illinois.
The Agency also proposed amendments to the Board’s procedural rules to include provisions for designating
outstanding resource waters in Illinois. On September 7, 2000, the Board accepted the proposal for hearing.
The Board has held three hearings in this matter. Several participants testified at the hearings, and the Board has
received a total of 47 comments in this proceeding.
The State of Illinois’ antidegradation policy and implementation procedures must be consistent with the components
detailed in the federal regulations. The components of the federal plan included a three-tiered approach. Currently,
the Agency reviews applications for NPDES permits to determine if the discharges to be permitted will degrade the
waters of the State. The Agency will continue to review antidegradation as part of the NPDES permit application
process.
The Board’s first notice proposal is similar to that filed by the Agency. However, the Board has proposed
amendments to its procedural rules in Part 102, rather than to Part 106 as suggested by the Agency. The first notice
proposal will be published in the
Illinois Register
on July 13, 2001. The Board will accept written public comment for
at least 45 days after the date of publication.

Board Adopts Proposal for Public Comment in Safe Drinking Water Act (SDWA) Update, USEPA Regulations
(July 1, 2000 through December 31, 2000), R01-20
On June 21, 2001, the Board proposed for public comment amendments to the Illinois regulations that are identical in
substance to the National Primary Drinking Water regulations adopted by the United States Environmental
Protection Agency (USEPA). These regulations implement Sections 1412(b), 1414(c), 1417(a), and 1445(a) of the Safe
Drinking Water Act (SDWA) (42 U.S.C. §§ 300g-1(b), 300g-3(c), 300g-6(a), and 300j-4(a)).
The amendments were proposed pursuant to Section 17.5 of the Environmental Protection Act (Act) (415 ILCS 5/17.5
(2000)), which provides for quick adoption of regulations that are “identical in substance” (IIS) to federal regulations
that USEPA adopts to implement Sections 1412(b), 1414(c), 1417(a), and 1445(a) of the SDWA. Section 17.5 also
provides that Title VII of the Act and Section 5 of the Administrative Procedure Act (5 ILCS 100/5-35, 5-40 (2000)) do
not apply to the Board’s adoption of IIS regulations. The federal SDWA regulations are found at 40 C.F.R. §§ 141
and 142. This docket includes federal SDWA amendments that USEPA adopted in the period July 1, 2000 through
December 31, 2000.
In this action, the Board proposed new monitoring requirements for uranium, a previously unregulated contaminant,
combined radium, and gross alpha particle, beta particle, and photon radioactivity. The proposal will be published in
the
Illinois Register
on July 13, 2001, commencing the 45-day public comment period.

Restricted Status List -- Public Water Supplies

The Restricted Status List was developed to give additional notification to officials of public water supplies which are
in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental Protection
Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a
violation of any of the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604,
Subparts B and C; maintenance of adequate pressure on all parts of the distribution system under all conditions of
demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502; or maintenance of treatment facilities
capable of providing water “assuredly adequate in quantity” as required by Section 18 of the Illinois Environmental
Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for
certain limited situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board
for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the
status of any public water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of July, 2001.

The Critical Review List was developed to give additional notification to officials of public water supplies which may be
close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental
Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the
violations, which would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to the
status of any public water supply should be directed to the Division of Public Water Supplies for final determination.
This list reflects the status as of July 1, 2001.
