By our order of January 21,
1993 the Board required Cabot
Corp.,
in part,
to submit a status report as follows:
Cabot shall submit a status report to the Board no
later than June 30,
1993 that clearly delineates the
status of its “Part 620 working plan”, the general
nature of any results then already submitted to the
Agency, and the general nature of any responses
received from the Agency.
On June 29,
1993, Cabot filed such a document with the Board.
That document outlines Cabot’s efforts towards resolving
outstanding issues with the Agency.
In its status report, Cabot represents that the Agency
approved its December
17,
1992 “investigation work plan” by
a
letter dated March
1,
1993.
According to Cabot Corp.,
the field
work in this plan took place in March and April,
and it is
currently analyzing the data.
Cabot intends to submit the report
from this study to
the Agency in the first half of July.
Cabot
further states that it presently anticipates draft Agency action
on its
RCRA
part B permit application in September,
1993 and that
this action may resolve groundwater issues still outstanding
between it and the Agency.
Cabot states that after
it has
received the draft Part B permit,
it will know whether it will
pursue the adjusted standard or to withdraw its petition.
Cabot
represents as follows:
“Cabot either will obtain an adjusted
standard or install secondary containment for its tank systems by
the dates secondary containment is required.”
For the foregoing reasons, the Board hereby modifies
Condition A of the previously-granted January 21,
1993 stay of
this proceeding through December
31,
1993 on TK-0048
& TK-0051.
The stay is subject to the following conditions:
A.
Cabot shall submit a status report to the Board no
later than September 30,
1993 that clearly delineates
the further action it intends in this proceeding in
light of its draft Part B permit, the general nature of
any unresolved issues in light of the Agency’s actions,
and the dates by which Cabot intends to pursue those
further actions; and
2
B.
Cabot will timely comply with the RCRA secondary
containment standards of 35
Ill. Adm. Code 725.293,
except as otherwise provided by Board order or
regulation.
