    ORDER OF THE BOARD (by T.E. Johnson):
     
    On January 23, 2003, at the parties’ request, the Board extended until April 14, 2003, the
    time period for U.S. Department of Energy to appeal a December 4, 2002 determination of the
    Illinois Environmental Protection Agency (Agency).

    415 ILCS 5/40 (2002); 35 Ill. Adm.
    Code 101.300(b), 105.204, 105.208. At issue was the Agency approval of a Resource
    Conservation and Recovery Act corrective action plan regarding U.S. Department of Energy’s
    landfill site at Argonne National Laboratory, DuPage County. Because petitioner failed to
    timely file an appeal, the Board dismisses this case and closes the docket.
