ORDER OF THE BOARD (by R.C. Flemal):

On August 16, 2001, Community Landfill Co. and the City of Morris (petitioners) filed a
permit appeal and a motion for expedited review (motion). Petitioners challenge the Illinois
Environmental Protection Agency’s (Agency) denial of petitioners’ supplemental permit
application. The Board accepts this matter for hearing.

In their motion, petitioners request that a hearing be held within 21 days and the Board
issue a decision within 60 days. Motion at 3. Petitioners allege the landfill will run out of
permitted air space, and petitioners will be left with no source of income to comply with the
permit conditions. Motion at 3. The motion for expedited review is granted, although the Board
declines to commit itself to the extraordinarily tight schedule proposed by petitioners. The
Board will schedule and complete hearings in an expedited and timely manner pursuant to the
applicable statutory decision deadline or as extended by waiver (see 415 ILCS 5/40(a)(2)(2000),
35 Ill. Adm. Code 101.308). Unless otherwise ordered by the hearing officer, the Agency shall
file the record of its review in this matter within 30 days of the filing of the petition. See 35 Ill.
    Adm. Code 105.116.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that the
above order was adopted on the 23rd day of August 2001 by a vote of 7-0.
