This matter is before the Board on a joint motion for
reconsideration,
filed on March 15,
1994.
On March 16,
1994,
petitioner Central Can Company filed
a supplement to the motion
for reconsideration.
The parties seek reconsideration of the
Board’s February 17,
1994 order directing that all hearings in
this matter be completed by July
1,
1994.
The parties ask that
the Board rescind our February 17 order, to allow more time to
obtain an interpretation from USEPA regarding issues in this
appeal.
The motion for reconsideration is granted. The parties have
presented new information regarding the progress of their
inquiries to USEPA.
We continue to believe, however, that
substantive action on this case cannot be delayed indefinitely.
Therefore, we order that all hearings in this matter must be
completed by October
1,
1994.
