ORDER OF THE BOARD
(by R.C.
Flemal):
On December
3,
1992,
the Board ordered the parties to file
status report to be received on or before February 1,
1993.
The
petitioner filed its status report on February 1,
1993.
The
respondent filed its status report on February 3,
1993, not
accompanied by a motion to file.
However, the Board will accept
the filing as it contains information needed for the record in
this proceeding.
The petitioner states that it continues in the process of
reviewing the work plan for the column leach test, and that it is
waiting for respondent’s review of the closure certification
statements for some of its tanks.
Petitioner states that it
cannot give an expected date for resolution of this matter
because it does not know when respondent will complete its
review.
Petitioner further supplies a “six month” waiver of the
decision
deadline
(due date calculates to December 23,
1993)’ to
allow the parties to continue to work toward resolution of the
matter.
Respondent states that it continues to review the column
leach test,
describing this as a new test that has not yet been
approved for use in Illinois.
The respondent states that the
parties have scheduled an oral status conference with the hearing
officer on March
1,
1993.
The parties are ordered to provide written status reports to
be received by the Board no later than March 16,
1993.
IT
IS SO ORDERED.
The Board notes that waivers to a calendar date certain
are required.
