On August 11,
1994,
the Board 4e—requested that the parties
file with the Board no later than September 9,
1994 their views
regarding what proceedings are appropriate in this case at this
time.
On September 8,
1994, the parties filed a joint report to
the Board.
The report states the parties agree that the five
underground storage tanks have been determined eligible by the
decision in Chemrex v. Pollution Control Board,(No.
1-93—0804
(1st Dist.)
(December 28,
1993).
The parties therefore suggest
that the Board remand this case to the Agency to determine the
applicable deductible and reasonableness of costs.
The Board agrees with the parties that the five tanks are
eligible for reimbursement.
Therefore,
the Board remands this
case to the Agency to determine the applicable deductible and
reasonableness of costs.
This docket is hereby closed.
