ORDER OF THE BOARD (by C.A. Manning):

On September 20, 2001, the Board, at the parties’ request, extended until December 10,
2001, the time period within which Dynegy Midwest Generation, Inc. (Dynegy) may appeal an
August 7, 2001 determination of the Illinois Environmental Protection Agency (Agency).
    See

    415 ILCS 5/40 (a)(1) (2000); 35 Ill. Adm. Code 105.406. The Agency granted Dynegy a permit
to construct an emission reduction project at its facility located at 2828 North Monroe Street,
Decatur, Macon County. Because Dynegy failed to timely file an appeal, the Board dismisses
this case and closes the docket.

    IT IS SO ORDERED.

I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, certify that the Board
adopted the above order on December 20, 2001, by a vote of 7-0.
