    (Permit Appeal)
    ILLINOIS ENVIRONMENTAL
    PROTECTION AGENCY,
    )
    Respondent.
    ORDER
    OF THE BOARD
    (by J. Theodore Meyer):
This matter is before the Board on petitioner Clayton
Chemical’s status report, received on February 4,
    1994.
    Clayton
Chemical states that since the last status report on November
    3,
1993, it has met several times with the Illinois Environmental
    Protection Agency
(Agency) regarding Clayton Chemical’s new Part
    B application.
Clayton Chemical states that the list of issues
on the new permit application is narrowing, and that on January
    25,
    1994,
it responded in writing to the Agency’s latest written
    continents.
Clayton Chemical reports that the Agency has
authorized it to represent that assuming the response is
sufficient, the parties are aiming toward a draft permit to be
    issued in June 1994.
The Board accepts Clayton Chemical’s status report.
    The
parties are directed to use their best efforts to adhere to the
June 1994 date for issuance of the draft permit.
    This appeal has
been pending for more than two years.
    Clayton Chemical is
directed to inform the Board when the draft permit is issued, no
later than 10 days after issuance.
    If
    it appears that the draft
permit will not be issued by the end of June 1994,
    the parties
shall inform the Board of the reason for the delay, and when
    (or
if) the draft permit will be issued.
    In any event, Clayton
Chemical and the Agency are directed to file updated status
    reports
    (or a joint report,
if the parties prefer) no later than
    July 1,
    1994.
    IT IS SO ORDERED.
