On February 7,
1992,
the Stiffel Company
(Stiffel) filed a
petition for an adjusted standard from 35 Ill. Adm. Code 218
Subpart F.
Stiffel and the Illinois Environmental Protection
Agency
(Agency)
have indicated that they have reached an
agreement on a plan for achieving compliance in this matter.
The
joint status report filed by the parties on September
9,
1994,
states that agreement has been achieved and that Stiffel has been
operating under that agreed compliance plan.
The parties,
however,
still state that a consent agreement has not been
finalized and request an additional three
(3) month stay.
The previous joint status report filed on March
2,
1994,
explained that the Agency found Stiffel’s plan regarding
compliance with the 35
Ill. Adm. Code Part 218, Subpart F
regulations to be acceptable.
The Agency and Stiffel anticipated
that the consent agreement which will be referred to the Office
of the Attorney General for finalization was pending.
However,
in this status report the parties state that no referral has been
made as a result of regulatory concerns.
Previously, the Agency also filed a motion for an extension
of time to file its response to the adjusted standard petition
which was granted making the reponse due September 15,
1994.
The
Agency has not filed a similar motion or the reponse, which is
now due,
as of the date of this order.
The parties’ motion for stay
is granted until December
15,
1994.
An updated joint status report is due to be filed on or
before December 9,
1994.
