This

matter is

before the Board

on

a

status

report filed July

27,

1994

by

the

Petitioner,

Olin

Corporation (Olin),

pursuant

to

a March

3,

1994 Board

Order.

The parties

have agreed on

a

means of resolving

this

RCRA permit

appeal

and are currently

pursuing

permit

modification and an

amendment to

the Part B application

to

conform

to

the

most

recent

Agency

Guidance document,

incorporating

all

modifications

since the permit was

filed

in

November,

1990.

In

the July 27,

1994

status

report

Olin

indicated that on

March

25,

1994,

Olin

submitted

its revised Part B

Permit application

to

the Illinois

Environmental

Protection

Agency

(Agency),

which

the Agency

is currently

reviewing.

Olin

also

noted that

the parties

expect any

remaining

issues

to

be resolved

by

mutual

agreement after review

of the

permit

modification request and

revised permit

application,

resulting

in

issuance of a

final permit

and

dismissal

of this appeal.

The Board

accepts

the status

report

and

notes that

a

decision deadline waiver

until

May

1,

1995

has been filed.

Accordingly, the Board

directs the parties

to

file a

status report

either on

or before November

17,

1994,

or within

14 days after the final Part B permit

is

issued,

whichever comes first.
