On February 7,
1992,
the Stiffel Company
(Stiffel) filed a
petition for an adjusted standard from 35 Ill.
Adm. Code 218
Subpart F.
Stiffel and the Illinois Environmental Protection
Agency
(Agency) have indicated that they have reached an
agreement on a plan for achieving compliance in this matter.
The
last joint status report filed by the parties on October
4, 1994,
states that the agreement will resolve all outstanding issues.
The Board issued an order granting a six
(6) month stay and
directed the parties to file another status report on or before
March
1,
1994.
The parties filed a joint status report on March
2,
1994.
The joint status report explained that the Agency found
Stiffel’s plan regarding compliance with the 35
Ill.
Adm. Code
Part 218, Subpart F regulations to be acceptable.
The Agency and
Stiffel anticipate that the consent agreement will resolve all
outstanding issues.
The joint status report requests a further
six
(6) month stay in this matter.
On March 2,
1994,
the Agency also filed a motion for an
extension of time to file its response to the adjusted standard
petition.
The motion requests the Board to grant an extension of
time which mirrors the stay request.
The parties’ motion for stay is granted.
The Agency’s
motion for an extension of time is granted.
An updated joint
status report, and the Agency’s response to the petition, are due
to be filed on or before September 9,
1994.
