ORDER OF THE BOARD
(by M. McFawn):
This matter is before the Board on a motion to join amended
petition for adjusted standard, filed by the Illinois
Environmental Protection Agency
(Agency) on March 20,
1995.
The
Agency seeks to join as a co—petitioner in the amended petition
for adjusted standard filed by Outboard Marine Corporation
(OMC)
on February 14,
1994, with certain amendments to the petition.
In support of its motion, the Agency states that it has been
involved in substantive discussions with OMC regarding the
regulatory language to be proposed to the Board.
The Agency has
included with its motion supplemental language that it proposes
to include in the joint petition.
The Agency states that it was
the understanding of the parties that the Agency’s motion for co-
petitioner status would include the proposed regulatory language.
The Agency further states that it anticipates that OMC will
provide formal testimony adopting the proposed language at
hearing.
The Agency’s motion for co—petitioner status is hereby
granted, and the petition for adjusted standard is hereby amended
to included the agreed-upon proposed regulatory language included
