ORDER OF THE BOARD
(by M. McFawn):
On December 23,
1993,
the Agency filed a motion for a 120-
day extension of time in which to file its record in this appeal.
Petitioner
has
not filed a response.
In support of its motion, the Agency notes that negotiations
in this matter have been ongoing, and that the parties believe
that the issues involved will be resolved “in short order”.
The
Agency notes that the decision deadline has been waived to
July 18,
1994.
The Board will grant the Agency’s motion for extension, but
will not grant the full 120 days requested.
Based on the current
decision deadline, the Board will grant the extension through
March 18,
1994
—
this would give the Board its full 120 days to
have hearing and briefing concluded in the event Board decision
is necessary in the event this matter is not resolved by
negotiation.
The Agency is,
of course,
free to request an
additional stay if the decision deadline is again waived.
IT IS SO ORDERED.
