    ORDER OF THE BOARD (by C.A. Manning):
     
    On December 4, 2002, the parties timely filed a joint notice to extend the 35-day period
    within which Carter Convenience Store (Carter) may appeal an October 24, 2002 determination
    of the Illinois Environmental Protection Agency (Agency).

    amended by
    P.A. 92-0574, eff. June 26, 2002; 35 Ill. Adm. Code 105.406. The Agency denied
    part of Carter’s request for reimbursement from the Underground Storage Tank Fund regarding a
    leaking underground storage tank site on Route 45 in Mill Shoals, White County. The Board
    extends the appeal period until February 26, 2003, as the parties request.

    Carter fails to file an appeal on or before that date, the Board will dismiss this case and close the
