ORDER OF THE BOARD
(by R.C. Flemal):
On March 31,
1995 St. Louis Auto Shredding (SLAS) and the
Illinois Environmental Protection Agency (Agency) filed a joint
status report pursuant to Board order of February 2,
1995.
SLAS
states that it received a Closure Certificate from the Agency on
March 30,
1995.
Due to the lengthy conditions in the Closure
Certificate, SLAS has not thoroughly reviewed it.
SLAS states
that it is not in a position to dismiss the permit appeal at this
time.
However, pending any unforseen significant new
requirements in the Closure Certificate, SLAS anticipates filing
a motion to dismiss in the near future.
The parties requests a further status report due by May 1.,
1995.
The Board accepts the joint status report and grants the
request for a new status date.
The Board directs SLAS and the
Agency to file a status report to the hearing officer by May 16,
1995 in the event that this matter has not already been resolved
and dismissed.
All future status reports shall be at the
direction of the hearing officer.
